Eligibility requirements
- Be recognised internationally as outstanding in a particular academic field. The field must be a body of specialised knowledge offered for study at an accredited U.S. university or higher-education institution.
- Have at least three years of teaching or research experience in that field. Experience while pursuing an advanced degree counts only under specified conditions, including completion of the degree and qualifying teaching responsibility or outstanding research.
- Have a qualifying offer: tenure or tenure-track teaching, permanent research at a U.S. university, or a permanent research position with an eligible private employer. A short project contract is not automatically a permanent research offer.
- A private employer’s relevant department, division or institute must employ at least three full-time researchers and demonstrate documented accomplishments in an academic field. Merely employing three engineers does not establish this test.
- Provide evidence satisfying at least two categories: major academic awards; selective associations; professional publications about the applicant’s work; judging; original scientific or scholarly contributions; or scholarly books/articles with international circulation. Comparable evidence may be relevant where the standards do not readily apply.
- The employer must make a genuine offer and meet the applicable ability-to-pay requirement. The complete record must establish outstanding international recognition, not only count publications.
Legal framework
INA §203(b)(1)(B), 8 USC §1153(b)(1)(B) ↗
Establishes international recognition, experience and qualifying employment conditions for outstanding professors and researchers.
8 CFR §204.5(i) ↗
Defines the academic-field, permanent-position and documentary requirements.
8 CFR §204.5(g)(2) ↗
Requires an employer petitioner to demonstrate ability to pay the offered wage as applicable.
Build the evidence
Prepare records that substantiate the relevant criteria. The final checklist depends on the applicant, route and filing authority.
- A detailed offer letter describing the academic field, research or teaching duties, permanent or tenure-track nature, salary and organisational placement.
- Experience letters from current or former employers with dates, author identity and duties; degree records and special evidence for any graduate-period experience relied upon.
- Independent evidence of recognition: documented use or influence of research, awards, scholarly publications, judging activity and context-specific expert assessments.
- For a private employer, research staffing records and documented academic-field accomplishments of the relevant unit. Distinguish operational engineering from genuine research activity.
- Employer financial records supporting ability to pay, along with corporate and organisational documents identifying the actual petitioner.
How to apply
- 01
Confirm the employer and role
Determine whether the institution or private research unit and the proposed appointment meet the category. Review permanence and research staffing before evaluating the applicant’s recognition.
- 02
Audit the experience and academic record
Build a precise timeline reaching three qualifying years. Test each proposed evidence category and the independent basis for international recognition.
- 03
Prepare the employer’s Form I-140
Assemble the offer, employer financial and research evidence, experience records and recognition exhibits. EB-1B does not require PERM labour certification.
- 04
Manage adjudication and changes
Respond to evidence requests with the employer. Assess changes in position, employer or research unit before assuming the petition remains usable.
- 05
Complete immigrant processing
When a visa number is available, proceed through eligible I-485 adjustment or consular processing, with family, medical and admissibility documentation.
After approval & family planning
- I-140 approval does not itself authorise employment or residence. The employee must maintain appropriate permission while waiting for the permanent-residence stage.
- Eligible spouses and unmarried children under 21 may seek derivative permanent residence, subject to individual child-age and visa-availability rules.
- If the employer or offered role changes before residence, review whether a new petition or a specific statutory portability provision is needed. Portability is conditional, not automatic upon I-140 approval.
Frequently asked questions
Can an industry researcher qualify?
Yes, where the private employer’s research unit and permanent role meet the regulations, including at least three full-time researchers and documented academic-field accomplishments.
Is a PhD mandatory?
The statute focuses on outstanding international recognition, qualifying experience and employment. A degree can support the record, but the category is not satisfied by holding a PhD alone.
Can graduate research count toward three years?
Only under the regulatory conditions. The degree must have been obtained and the qualifying research must have been recognised as outstanding, or teaching must have involved full responsibility for the class.
Can I self-petition if my employer will not sponsor?
Not under EB-1B. Assess EB-1A or NIW separately if supported by the applicant’s profile and plans.
Are two publications enough?
No. Two publications are not two different regulatory categories. Even when two categories are satisfied, the record must establish international recognition as outstanding.
Does a permanent research position mean a lifetime employment guarantee?
No. The regulations contemplate indefinite or unlimited duration with an expectation of continued employment unless there is good cause for termination. The real appointment terms require assessment.
Points to consider
- Do not re-label a fixed short-term project or ordinary technical role as permanent research solely for immigration purposes.
- Visa-number availability, admission restrictions and consular conditions remain separate from the employer petition.
