Who can qualify

Eligibility requirements

  • First qualify for EB-2 as a member of the professions holding an advanced degree or equivalent, or as a person of exceptional ability in science, arts or business. A relevant bachelor’s degree plus five years of progressive post-degree experience can meet the advanced-degree equivalence rule.
  • For exceptional ability, establish the required expertise through at least three regulatory evidence categories: relevant academic record, ten years of full-time experience, professional licence, remuneration demonstrating ability, professional membership, or recognition for achievements and contributions. The complete record must substantiate exceptional ability.
  • Prong one: define the specific proposed endeavour and demonstrate both substantial merit and national importance. The value of an occupation or sector in general is not enough.
  • Prong two: demonstrate that the applicant is well positioned to advance that endeavour through relevant achievements, progress, plans, resources and credible stakeholder interest. Success is not guaranteed, but the plan must be supported.
  • Prong three: show why, on balance, the United States benefits from waiving the job-offer and labour-certification requirements. Explain the actual circumstances rather than asserting that all entrepreneurs deserve a waiver.

Build the evidence

Prepare records that substantiate the relevant criteria. The final checklist depends on the applicant, route and filing authority.

  • Degrees, transcripts and properly detailed employment letters supporting the underlying EB-2 qualification and its relevance to the endeavour.
  • A specific endeavour statement: the problem, intended U.S. activities, milestones, beneficiaries and the mechanism by which the work can produce broader impact.
  • Objective support for importance and feasibility, such as research adoption, funded projects, commercial commitments, credible pilot results or government/industry interest.
  • A record of relevant accomplishment, including publications, patents, implementation, licences, leadership or independently documented business outcomes as appropriate.
  • Detailed letters from qualified people explaining their factual basis and direct knowledge, alongside independent exhibits. A business plan and recommendation letters alone do not prove national importance.

How to apply

  1. 01

Test EB-2 qualification before drafting the waiver

Confirm the degree or exceptional-ability route, required experience and relationship between qualifications and the intended work.

  2. 02

    Develop an evidence-led endeavour case

Define the U.S. contribution precisely and identify which independent evidence supports each Dhanasar prong. Separate forecasts from already achieved results.

  3. 03

    File the immigrant petition

Submit Form I-140 with the current required evidence, including the applicable Form ETA-9089 components: Appendix A and the signed Final Determination, following the current USCIS checklist. These documentary components do not mean that a DOL-approved PERM labour certification is required for NIW.

  4. 04

Respond to adjudication and track visa availability

Address any evidence request. Petition approval establishes the classification; it does not by itself provide lawful status, employment permission or an immediately available immigrant visa.

  5. 05

    Complete residence processing

When eligible and a visa number is available, proceed with Form I-485 adjustment of status or consular immigrant-visa processing, including medical, identity and admissibility requirements.

After approval & family planning

  • An eligible spouse and unmarried children under 21 may pursue derivative immigrant status, subject to child-age rules and visa availability. Each family member’s case needs separate documentation.
  • Keep evidence that the qualifying endeavour and intention to pursue it remain genuine. Material changes before residence is granted should be reviewed promptly.
  • Maintain an independent lawful status and work authorisation while waiting where required. The I-140 receipt or approval is not an employment authorisation document.

Frequently asked questions

Is a job offer required?

A granted NIW waives the normal job-offer and labour-certification requirements, and the individual may self-petition. The applicant still needs a credible plan for the proposed endeavour.

Can a startup founder qualify?

Potentially. The case should connect the founder’s relevant capability and tangible progress to broader U.S. impact. Incorporation, fundraising intentions or projected jobs alone do not establish the waiver.

Do I need a PhD or a minimum citation count?

No universal PhD or citation threshold exists. Establish underlying EB-2 eligibility and the three prongs using evidence appropriate to the field and endeavour.

Does working in semiconductors or AI automatically meet national importance?

No. Explain how this particular endeavour may improve capabilities, adoption, supply resilience or other broader outcomes, and substantiate the applicant’s ability to advance it.

Will premium processing make a green card immediately available?

No. A faster petition adjudication, where available, does not remove visa-number limits, consular processing or adjustment requirements.

Points to consider

  • A successful professional history and a nationally important endeavour are different questions. Evaluate both before filing.
  • Current Visa Bulletin availability, nationality-specific restrictions and consular rules remain relevant; approval and processing time are not guaranteed.
