Eligibility requirements
- Establish extraordinary ability demonstrated through sustained national or international acclaim and recognition of achievements in the field. The case should identify the relevant field coherently rather than change its definition to suit individual exhibits.
- Show a qualifying one-time major internationally recognised award or at least three regulatory categories. Awards, memberships and media coverage have specific quality and relevance tests; their mere existence is insufficient.
- The ten evidence categories cover recognised prizes; selective memberships; published material about the applicant; judging; original contributions of major significance; scholarly articles; artistic exhibitions; leading or critical roles for distinguished organisations; high remuneration; and commercial success in performing arts.
- If a regulatory standard does not readily apply to the occupation, explain why comparable evidence is appropriate. Comparable evidence is not a substitute for missing achievements where the ordinary criterion applies.
- Demonstrate an intention to continue work in the area of expertise in the United States and how the work will prospectively benefit the country. No single employer is mandatory, but the plan must be credible.
- Establish the required statutory standard through the whole record. An approval in a different visa category, a high salary or a collection of recommendation letters does not automatically meet it.
Legal framework
INA §203(b)(1)(A), 8 USC §1153(b)(1)(A) ↗
Requires extraordinary ability, sustained acclaim, continued work in the field and substantial prospective benefit to the United States.
8 CFR §204.5(h) ↗
Provides the award/evidence-category framework and permits filing without an employer or labour certification.
USCIS Policy Manual, Volume 6, Part F, Chapter 2 ↗
Explains evaluation of evidence and the overall extraordinary-ability standard.
Build the evidence
Prepare records that substantiate the relevant criteria. The final checklist depends on the applicant, route and filing authority.
- An evidence table identifying the exact criterion, source, date, applicant’s individual contribution and the reason the exhibit meets the legal wording.
- Independent impact records: adoption, citations in context, commercial implementation, recognised contributions, competitive awards or other appropriate evidence of field-level recognition.
- Complete publication and media records showing author, date, outlet and coverage, with translations and information about the publication’s standing.
- Judging invitations and proof the judging was actually performed; membership selection standards; role evidence identifying the organisation’s reputation and the applicant’s contribution.
- A credible U.S. continuation plan supported, where available, by contracts, prospective engagements, business activity, research plans or other commitments.
How to apply
- 01
Assess the standard and alternatives
Compare EB-1A with NIW or employer-sponsored EB-1B where relevant. Identify whether the record demonstrates sustained recognition at the required level rather than simply professional competence.
- 02
Build a verifiable evidence narrative
Select the strongest criteria and explain context. Distinguish the applicant’s own achievements from those of a team, employer or funded company.
- 03
File Form I-140
Submit the immigrant petition, current fee and indexed evidence. A self-petitioner does not need a PERM labour certification or employer job offer for EB-1A.
- 04
Respond and monitor the priority date
Address requests for evidence or other notices. Follow the Visa Bulletin and the applicable USCIS filing-chart guidance if seeking adjustment of status.
- 05
Complete the residence application
Use eligible adjustment of status or consular processing when a visa is available. Continue to satisfy admissibility and the intention to work in the field.
After approval & family planning
- The approved I-140 is a classification decision; it does not alone give permission to live or work in the United States. Maintain the appropriate status and employment authorisation until residence is effective.
- Eligible spouses and unmarried children under 21 may obtain derivative permanent residence, with child-age protection and visa availability reviewed individually.
- No employer lock-in is inherent in self-petitioning, but the intended continued work in the area of extraordinary ability must remain genuine. Review significant changes before residence is granted.
Frequently asked questions
Do three criteria guarantee approval?
No. The submitted evidence must establish sustained acclaim and the required level of expertise. Three weakly documented categories do not replace a compelling overall record.
Can a business founder qualify without academic publications?
Potentially. Business-related contributions, critical roles, recognised awards, independent coverage and remuneration may be relevant. The evidence must fit the actual criterion and demonstrate the founder’s personal standing.
Is an O-1 approval sufficient?
No. It may provide useful background but EB-1A is a separate immigrant adjudication with its own criteria and legal standard.
Is there a fixed number of citations or awards?
No universal number guarantees approval. Quality, independence, field context and significance matter; avoid manufactured metrics or purchased recognition.
Can I file without a U.S. job offer?
Yes. Self-petitioning is permitted, but a credible intention to continue the qualifying work in the United States must be documented.
Is the green card immediate after I-140 approval?
No. Visa-number availability, adjustment or consular requirements and admissibility still apply.
Points to consider
- Keep original evidence and an accurate record of contributions. Do not misrepresent paid publicity, routine memberships or team achievements as independently qualifying personal distinction.
- Screen nationality-specific restrictions and consular rules independently of petition eligibility. No approval rate or fixed processing time is promised.
