Two different tests, two years apart
The Top Talent Pass Scheme admits people on the strength of their past: an annual income of HK$2.5 million or more in the preceding year for Category A, or a bachelor's degree from a university on the Labour and Welfare Bureau's list, with three years' experience (Category B) or without (Category C, quota-limited). No job offer is needed and the initial stay, 36 months for Category A approvals from 16 October 2024 and 24 months for Categories B and C, carries no condition other than time. The Immigration Department (ImmD) states that this initial permission is granted only once per applicant.
The extension applies a different test. ImmD's published criteria require the applicant to prove either stable employment in Hong Kong or a business established or joined in Hong Kong. Employment must be at a level usually held by degree holders or professionals, with remuneration at market level. A business must be operating healthily and sustainably and contributing to the economy, assessed on turnover, financial resources, investment, local jobs created and length of stay. The standard extension is up to three years, or to the end of the contract if shorter. A Category A record of HK$2.5 million earned abroad is irrelevant at this stage; the question is what the holder has done in Hong Kong since arrival.
The scale of the renewal question is now visible. The Government told the Legislative Council in April 2025 that nearly 99,000 TTPS applicants had been approved by the end of February 2025, over 25,000 of them under Category A. The first large cohort of 24-month passes began expiring in late 2024, and the Government introduced a transitional measure: the roughly 21,000 Category A holders approved before 16 October 2024 could apply, within three months of expiry, for an unconditional one-year extension, or for up to three years on proof of a job or business. That measure recognised that many had not yet established themselves. It did not change the substantive test for everyone else.
What 'stable employment' means in practice
ImmD does not publish a salary figure for TTPS extension, and WG does not invent one. The published wording has three limbs, and each has a practical meaning.
- Level. A job usually held by degree holders or professionals. Titles do not decide this; duties do. An applicant with a Category A income history who takes a clerical or sales-support role in Hong Kong should expect questions. ImmD states that intra-company transfers to managerial or professional roles may also qualify, which matters for executives moved into a Hong Kong affiliate by their existing group.
- Market remuneration. The package should be defensible against comparators for the role in Hong Kong. A nominal salary paid by a related company to create a payroll record is the pattern most likely to fail, because it is also the pattern that fails the 'genuine' element across every ImmD scheme.
- Stability. A continuing contract, payslips over a period, MPF contributions and, where the year has closed, a salaries tax demand note. An offer letter dated the week before filing is evidence of a plan, not of stable employment.
Two further points are easy to overlook. Category B and C holders who did not complete degree verification at the initial application must do so at extension. And the application must be made within three months before expiry and at least six weeks before; ImmD states that the applicant must leave Hong Kong before the limit of stay expires even while an application is pending, unless the Director approves otherwise. ImmD's online submission process may also require completion of a Hong Kong Talent Engage survey before filing; check the current instructions on the ImmD page.
What a 'genuine business' looks like
The business limb is assessed on the same factors ImmD applies to the entrepreneur stream of the General Employment Policy: turnover, financial resources, investment, local jobs and, for TTPS, length of stay. A company incorporated in month 22 with no revenue, no employees and the holder as sole director will not meet the description of operating healthily and sustainably. A company with audited accounts, a Hong Kong office, local staff on MPF and contracts with Hong Kong or regional customers will.
The 2026 Policy Address announced a relaxation for one group: proprietors of technology start-ups supported by designated public-sector organisations are to be exempted from providing proof of company income at extension. That reflects the reality that an early-stage research company may have no revenue in its first two years. It does not remove the need to show that the company exists, operates and is supported by a recognised body; check ImmD for the implementation date and the list of designated organisations before relying on it.
For a holder who has joined rather than founded a business, ImmD will want to see the role as well as the company. A shareholding in a trading company with no active role is an investment, not employment or business participation.
The top-tier stream and the six-year extension
After at least two years under the TTPS and assessable salaries tax income of not less than HK$2 million in the previous year of assessment, a holder may apply under the top-tier employment stream, which normally grants six years on time limitation only. This is the natural target for Category A entrants who take a senior Hong Kong role: the HK$2 million figure is assessed on Hong Kong salaries tax, so it requires real Hong Kong employment income, documented by the Inland Revenue Department's assessment. Income earned abroad does not count.
The top-tier stream is therefore both a reward and a filter. It identifies the holders whose Hong Kong employment is real enough to generate a HK$2 million assessment, and it leaves the remainder on three-year extensions that will be re-examined each time.
Preparing from the first month
The practical advice is simple to state. Treat the initial pass as a 24- or 36-month window to build an extension file, not as a residence permit. Take a degree-level role at market pay with a Hong Kong employer, or build a business with staff and customers. Keep every payslip, MPF statement and tax note. Log every absence, because the same records will be examined again for the right of abode at year seven, where ImmD looks at habitual residence, employment and where the family lives. If the holder's role is with a group company abroad, ask early whether an intra-company transfer to the Hong Kong affiliate, on the Hong Kong payroll, is the honest structure.
The mobility-capital point is the same as the compliance point. The TTPS pays off for people who do real work in Hong Kong, and only for them. The pass opens the door; the record of work keeps it open.
